Npp Slabs Kpandai Judgment: Calls It “Unmitigated Legal Disaster”

The New Patriotic Party (NPP) has expressed outrage over the judgment delivered by the court, which called for a rerun of the Kpandai elections, describing it as an “unmitigated legal disaster”.

Speaking at a press conference, lawyer Henry Nana Boakye, National Organizer of the NPP, stated that the party won the Kpandai elections with a decisive margin of 3,734 votes, and that the court’s decision to void the election was a clear injustice.

Nana Boakye argued that the petitioners’ own evidence showed that they were challenging only 41 polling stations, with a total of around 500 votes involved, and that the court had ignored the requirement to only consider the affected results.

“The court leaped recklessly from ‘there were irregularities’ to voiding the entire election. This is not law, this is not justice. Clearly, this is injustice,” Boakye stated.

He added that the New Patriot party (NPP) would not accept the judgment and would resist it, citing the party’s commitment to democracy and the rule of law.

Lawyer Nana Boakye also pointed out that the court’s decision was in contravention of established principles, including the requirement that non-compliance with electoral laws must be significant enough to affect the outcome of the election.

He quoted the Elections Manual, which states that “where proven irregularities could not possibly change the results, the election must stand”.

The NPP National Organizer also accused the court of deliberately ignoring Regulation 48(2) of CI 127, which states that the non-attendance of candidates or agents does not invalidate acts done by the returning officer.

“This is what Regulation 48 says. Yet the judge had to void the entire election… This is a sham,” Boakye stated. The NPP is calling on all Ghanaians who cherish democracy to join them in resisting this judgment and defending the rule of law.
