Court orders rerun of Kpandai Parliamentary election
The Tamale High Court has directed a rerun of the Kpandai parliamentary election, ordering that a fresh poll be conducted within 30 days.
The ruling, delivered by His Lordship Justice Emmanuel Brew Plange, follows a legal challenge to the results of the 2024 parliamentary election in the constituency. The petition alleged irregularities in the voting and collation processes that compromised the credibility of the outcome.
Daniel Nsala Wakpal, the former Member of Parliament (MP) and National Democratic Congress (NDC) parliamentary candidate for Kpandai, filed the suit challenging the election of Matthew Nyindam as MP.
According to Wakpal, the parliamentary election held on December 7, 2024, was invalid due to discrepancies in FORM 8A (Regulation 32(7) and 39(2) Statement of Polls for the Office of Member of Parliament — Pink Sheet) at 41 of the 152 polling stations in the constituency.
Wakpal argued that the election did not comply with Regulations 39 and 43 of the Public Elections Regulations, 2020 (CI 127), contending that the irregularities affected the results of the election. He sought an order to set aside the results from the 41 affected polling stations and requested a rerun in those areas.
Justice Plange upheld the petition, ruling that the Electoral Commission must organise a new election to determine the rightful winner of the Kpandai parliamentary seat.
