The Accra High Court has dismissed an injunction application filed by New Patriotic Party (NPP) parliamentary candidate, Nana Akua Afriyie, which sought to block the Electoral Commission (EC) from conducting a rerun of elections in 19 polling stations.
The former Member of Parliament for Ablekuma North filed the application as part of a judicial review process, arguing that the EC’s decision contradicts a previous High Court ruling issued on January 4, 2025. That judgment directed the Commission to collate and declare results from all 281 polling stations in the constituency, not to organise fresh polls.
Representing Nana Akua in court, lawyer Gary Nimako contended that the EC had already admitted—through sworn testimony by its Deputy Chairperson, Dr. Bossman Asare—that only three polling station results were outstanding and that police support had been requested to complete the collation.
Mr. Nimako insisted the Commission’s current plan to rerun voting in 19 polling stations violates the court’s earlier directive and amounts to contempt. He urged the presiding judge, Justice Alibaba Abature, to summon the EC to explain its actions within 10 days.
However, in delivering his ruling, Justice Abature found the ex-parte application to be “unmeritorious” and dismissed it.
The EC is scheduled to proceed with the rerun elections on Friday, July 11, 2025, despite the legal challenge. The ruling clears the way for the Commission to continue with its plans, although the controversy surrounding the interpretation of the January court order remains unresolved.
