Supreme Court confirms Matthew Nyindam as Kpandai MP

The Supreme Court has overturned a High Court ruling that had annulled the election of Matthew Nyindam as Member of Parliament for Kpandai.

By a majority decision of 4–1 delivered on Wednesday, January 28, 2026, the apex court quashed the judgment of the Tamale High Court, which had nullified the parliamentary election results for the Kpandai Constituency.

The Supreme Court held that the High Court lacked jurisdiction to hear the election petition filed by the defeated NDC candidate, Daniel Nsala Wakpal, because it was filed outside the statutory time limit.

The case came before the Supreme Court following a judicial review application filed by Lawyer Gary Nimako, Director of Legal Affairs for the New Patriotic Party (NPP). As a result, the planned parliamentary rerun in Kpandai will no longer take place.

The decision effectively confirms Matthew Nyindam as the duly elected MP for Kpandai, ensuring that the NPP retains all 87 of its parliamentary seats.

Earlier, in December 2025, the Supreme Court had ordered the Electoral Commission (EC) to suspend all proceedings and activities related to the Kpandai rerun pending the final determination of the case. The EC had initially scheduled the rerun for December 30, 2025, after being notified by Parliament that the seat was vacant.

The Tamale High Court, led by Justice Emmanuel Brew Plange, had annulled the 2024 parliamentary election results for Kpandai and directed a fresh poll within 30 days. The petition by Daniel Nsala Wakpal alleged that the December 7, 2024, election was plagued by serious irregularities, including inconsistencies in Form 8A (“pink sheets”) from 41 out of 152 polling stations. The petitioner claimed that these breaches violated Regulations 39 and 43 of the Public Elections Regulations (CI 127).

With the Supreme Court’s ruling, the NPP’s hold on Kpandai is officially reaffirmed, bringing closure to a months-long legal dispute.
