The Supreme Court has overturned the declaration made by Speaker of Parliament, Alban Bagbin, on October 17, 2024, regarding four vacant seats.
In a 5-2 majority ruling on Tuesday, November 12, 2024, the court deemed the declaration unconstitutional.
The seven-member panel, headed by Chief Justice Gertrude Torkornoo, delivered a verdict in favor of Efutu MP, Alexander Afenyo-Markin, who was the plaintiff in the case.
Chief Justice Torkornoo mentioned that a detailed explanation of the ruling would be available at the Registrar’s office by Wednesday, November 13, 2024.
“In a majority decision of five to two, with Lovelace Johnson JSC and Ahmadu Tanko JSC dissenting on the issue of jurisdiction, the plaintiff’s action has been successful.
The full reasons and orders of the court will be filed with the registrar by the end of the day tomorrow, November 13, 2024. This is the judgment of the court,” the Chief Justice announced.
